Over the years, I have had several people ask why it is helpful to hire an attorney early in a case, especially where they don’t even know if they will need to make a claim or not. Also, I have spoken with some other personal injury attorneys who will only sign a client up after the client has finished treatment.
I am of the opinion that there is a lot I can do to be helpful early in a case and it is always worth it to hire an attorney early, or at least talk to one early so you know what to do and what not to do in a personal injury case.
Most personal injury attorneys work on a contingency fee. That means they don’t charge upfront and they only charge a fee if they successfully resolve your case. Typically, any attorney that does this will charge you the same percentage whether you sign up early and get the benefit of assistance throughout your case, or sign up at the end when you are ready to negotiate with the insurance company. Why would you, as the client, want to pay a third of your settlement to an attorney who only stepped in the help at the 11th hour? Get your full money’s worth and hire the attorney early.
There is so much that can be done at the onset of a case that will help relieve the burden from the injured person that it is always a good idea to talk to an attorney early. I can answer your questions starting from day one, I can assist you with making sure the property damage issues are handled well, I can advise you as to all your options for financing your medical care, I can dispel the common myths, I can get the insurance adjusters off your back, and the list goes on.
If you have only suffered a minor injury and end up not needing to make a claim afterall, I will not charge you for using my services in the meantime. Where there is no claim to be made, my contingency fee agreement allows you to have the peace of mind that you had the legal assistance while you needed it without the additional burden of paying legal expenses out of pocket. I would rather have someone come to me just in case they need to make a claim and help them through any hurdles and answer their questions so that they are informed, than have them do it themselves and wonder if they did the right thing. That is still true even where I don’t end up charging a fee on their case.
Anytime a person has been injured by someone else, they are entitled to at least have their questions answered by a qualified attorney.
Anytime a person hires an attorney, they are entitled to full assistance on their case, from beginning to end. The client should expect to have opportunities to speak directly with the attorney for any legal questions on the case. The client should expect to be given all their options and have the pros and cons explained for different options. The client should expect that the attorney will have the client’s best interests in mind.
